REGULAR MEETING
May 17, 2006

Mayor Bouer called the Regular Meeting of the City Council of the City of Laguna Woods to order at 2:00 p.m.
Mayor Pro Tem Robbins led the flag salute.

Moved by Mayor Pro Tem Robbins, seconded by Councilmember Ring, and carried unanimously to approve the City Proclamations 5.1 – 5.8.

5.3 Proclamation – Emergency Medical Services Week – May 14-20, 2006

Moved by Councilmember Hack, seconded by Mayor Pro Tem Robbins, and carried unanimously to approve Consent Calendar items 6.1 – 6.6.
6.1 Approved City Council minutes from the regular meeting of April 19, 2006.
6.2 Approved the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived.
6.3 Treasurer’s Report
Received and filed April 2006 monthly Treasurer’s Report and Third Quarter Fiscal Year 2005-06 Treasurer’s Report.
6.4 Warrant Register
Approved the May 17, 2006 Warrant Register in the amount of $358,209.52.
6.5 Notice of Completion – Dicksons, Inc. – 2005-2006 Energy Efficiency Improvement Project: Installation of Heat Pump Units
6.6 Golf Cart and Low Speed Vehicle Regulations
Adopted Ordinance 06-03 establishing regulations for the use of City sidewalks and golf cart paths, entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, REGULATING THE USE OF GOLF CARTS AND LOW-SPEED VEHICLES ON PUBLIC SIDEWALKS

VIII. CITY COUNCIL
8.1 Measure M Reauthorization (agendized by Councilmember Hack)
City Manager Keane introduced Peter Herzog who provided an update on efforts to reauthorize Measure M. Councilmember Hack discussed benefits the City had received from the Measure M tax. He reminded residents that this would not be a new tax, but a continuation and urged residents to vote in favor of the continuation of Measure M.
Councilmembers discussed some benefits received from Measure M and recommended support for the renewal of the Measure M tax.
Libby Marks, resident, discussed the inability to purchase a Metrolink pass. The Executive Director from OCTA stated he would look into.
Moved by Councilmember Hack, seconded by Mayor Pro Tem Robbins, and carried unanimously to approve Resolution No. 06-09 entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, APPROVING THE MEASURE M TRANSPORTATION INVESTMENT PLAN AND SUPPORTING REAUTHORIZATION
8.2 Eminent Domain Proceedings in the City of Laguna Woods (agendized by Councilmember Ring)
Councilmember Ring asked the Council to approve a resolution that would clarify the City’s intentions with respect to the use of eminent domain proceedings. He stated that residents believe that the City has the authority to take their homes for redevelopment purposes. Councilmember Ring read the complete resolution and also discussed the Orange County Measure A, which is on the June 6, 2006 ballot. Councilmember Hack discussed his concerns with the proposed resolution. At the request of Councilmember Hack, City Attorney McEwen provided an explanation of eminent domain proceedings in California.
Marty Rhodes, resident, stated he had been involved in an eminent domain process where commercial property and apartment owners declared the area blighted and he felt this could also be done here.
Moved by Councilmember Ring, seconded by Mayor Pro Tem Robbins, and carried unanimously to approve Resolution No. 06-10 entitled.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ESTABLISHING A POLICY REGARDING THE USE OF EMINENT DOMAIN
8.3 City Council Meeting Schedule
City Manager Keane reported there was a conflict with the scheduled June 7, 2006 budget meeting and recommended moving the meeting to June 14, 2006.
Moved by Mayor Pro Tem Robbins, seconded by Councilmember Ross, and carried unanimously to reschedule the June 7, 2006 budget meeting to June 14, 2006.
9.1 Construction and Demolition Waste Regulations
Assistant City Manager Reilly reported that cities are required by state law to divert 50% of their waste from landfills. Construction and demolition (C & D) waste is a significant portion of the waste
The C & D regulation would establish requirements that commit applicants to diverting C & D waste, by self hauling, using the City’s franchised waste hauler or other permitted haulers. Large projects, valued at $25,000 and above would require submission of plans and security deposits to ensure reasonable diversion of this waste. Smaller projects would complete a simple Recycling Form that commits to self hauling or using either the City’s franchised waste hauler or other permitted hauler. Confirmation of proper disposal would be required only if the City’s franchised hauler is not used.
On March 22, 2006 the Community Services Committee voted unanimously to recommended adoption of this ordinance.
Mary Stone, resident, supported the proposed regulations. She questioned if a permit is required for carpet removal. Assistant City Manager Reilly advised a permit is not required for carpet removal.
Moved by Councilmember Hack, seconded by Councilmember Ross, and carried unanimously to introduce and approve first reading of an ordinance establishing regulations for the disposal of construction and demolition waste, entitled:
AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AMENDING THE LAGUNA WOODS MUNICIPAL CODE BY ADDING A NEW CHAPTER 4.24, CONSTRUCTION AND DEMOLITION MATERIALS MANAGEMENT, TO TITLE 4 OF THE LAGUNA WOODS MUNICIPAL CODE
9.2 Taxi Voucher Subsidy Program
City Manager Keane advised that at the May 10, 2006 meeting, Council reauthorized the taxi voucher subsidy program for an additional year. Council also discussed lowering the currently eligibility age for the general and special destinations voucher programs from 70 to 62.
City Manager Keane recommended that since residents were making plans for travel that would extend past the current expiration, that the program be reauthorized for an additional year through June 30, 2007 now. She further recommended that the age requirement be lowered to 60 since the OCTA grant establishes a minimum age of 60 and the non-emergency medical transportation program has an eligibility age of 60.

9.3 Fiscal Year 2006-07 Budget – Transportation and Grant Funds
City Manager Keane provided an overview and answered questions on the projected revenues and expenditures for the Transportation Fund, Insurance Fund and Grants Fund. Council did not request any new or expanded programs. City Manager Keane advised she would present the complete budget for Council review on June 14, 2006.
City Attorney McEwen discussed a claim filed in another city where an employee hit his own car with a city dump truck and filed a claim with the City for damage to his car. The city denied the claim and the employee’s wife has now filed a claim.
11.1 El Toro Reuse Planning Authority (Councilmember Hack)
Councilmember Hack reported that nothing was currently happening since Los Angeles World Airway asked state legislators to introduce legislation.
11.2 San Joaquin Corridor Authority (Councilmember Hack)
Councilmember Hack reported that SJAC was looking at future financial solutions.
11.3 Vector Control District (Mayor Bouer)
Mayor Bouer stated that 10 birds had tested positive for West Nile Virus. The next meeting was scheduled for Thursday.
11.4 Library Board (Mayor Pro Tem Robbins)
Mayor Pro Tem advised he had attended two budget meetings which approved spending increases in library materials and books. He also reported on the ability to install free software and download books to your PC by going to www.ocpla.org.
11.5 Orange County Fire Authority (Councilmember Ross)
Councilmember Ross reported there had not been a meeting.
11.6 Laguna Canyon Foundation (Councilmember Ring)
Councilmember Ring announced there would be an Open House on October 28 for the Nix Nature Center and he would have construction pictures at the next council meeting.
11.7 Coastal Greenbelt Authority (Councilmember Ring)
Councilmember Ring advised there would be a meeting on Thursday at 1:30 p.m.

XIII. CITY COUNCIL COMMENTS AND ANNOUNCEMENTS
Councilmember Hack advised the City Manager is in discussion with the City of Irvine and the Irvine Company regarding mitigation for Irvine’s proposed general plan amendment.
City Manager Keane reminded Council and the audience that the Chautauqua Antique Fair was that weekend at the Laguna Woods Village Clubhouse 2.
XIV. CLOSED SESSION
City Attorney McEwen advised there would not be a closed session.
