REGULAR MEETING
March 15, 2006
2:00 P.M.
Mayor Bouer called the Regular Meeting of the City Council of the City of Laguna Woods to order at 2:00 p.m.
Councilmember Ross led the flag salute.
III. ROLL CALL

Moved by Councilmember Ring seconded by Councilmember Ross, and carried unanimously to approve the City Proclamations 5.1 – 5.4.
5.1 Commendation – Dorothy Watson – 100th Birthday
5.2 Proclamation – National Crime Victims’ Rights Week – April 23-29, 2006
5.3 Proclamation – Women’s History Month – March 2006
5.4 Proclamation – National Donate Life Month – April 2006
Moved by Mayor Pro Tem Robbins, seconded by Councilmember Ross, and carried unanimously to approve Consent Calendar items 6.1 – 6.7.
6.1 Approved City Council Minutes from the regular meeting of February 18, 2006.
6.2 Approved the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived.
6.3 Treasurer’s Report
Received and filed February 2006 monthly Treasurer’s Report.
6.4 Warrant Register
Approved the March 15, 2006 Warrant Register in the amount of $447,340.91.
6.5 California Integrated Waste Management Board Rubberized Asphalt concrete Incentive Grants

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AUTHORIZING THE SUBMITTAL OF AN APPLICATION FOR A TARGETED RUBBERIZED ASPHALT CONCRETE INCENTIVE GRANT
6.6 Amendment to Cooperative Agreement D99-128 to fund (TMDL) Studies in the Newport Bay Watershed.
Approved an amendment adding new cost sharing partners to the exiting Newport Bay Watershed. Studies agreement; and authorized the Mayor to execute the agreement subject to approval as to form by the City Attorney.
6.7 Urban Area Security Initiative (UASI) Funding Agreement
Approved an agreement providing pass through funding from the City of Santa Ana to the City of Laguna Woods for the purchase of Urban Area Security Initiative equipment and training; and authorized the City Manager to execute the agreement subject to approval from the City Attorney.

VIII. CITY COUNCIL
8.1 City Council 2006 Meeting Schedule
City Manager Keane briefly discussed the proposed 2006 Council meeting schedule, which includes five meetings to discuss the 2006-07 budget.
Moved by Mayor Pro Tem Robbins, seconded by Councilmember Ring, and carried unanimously to approve the 2006 Council Meeting Schedule as presented.
8.2 Citizen Advisory Committee Appointment
City Clerk Condon advised that Councilmember Hack nominated Dolores Fruchtman to fill the opening on the Community Services Committee. She advised there are also two opening on the Human Relations Committee.
Moved by Councilmember Hack, seconded by Mayor Pro Tem Robbins, and carried unanimously to appoint Dolores Fruchtman to the Community Services Committee
9.1 Laguna Woods Smoking Regulations
City Manager Keane advised that smoking regulations were adopted by Council in August 2004. In December 2005, Council discussed possible changes to those regulations. Staff was requested to bring back recommendations relating to smoking in carports that are shared by more than one residential unit and on sidewalks and outdoor entryways that are within 20 feet of the entrance to any individual residential unit. Council also directed staff to look at what other cities were doing. City Manager Keane reported that in February the CA Air Resources Board identified second hand tobacco smoke as a toxic air containment and several beach cities have banned smoking on beaches basically to eliminate littering,
Staff recommended banning smoking on public sidewalks, not just from a concern of second hand smoke, but related to litter and water quality issues.
Councilmember Hack expressed concern about enforcement of smoking regulations and recommended reviewing the litter regulations. City Manager Keane advised that enforcement would be handled by the code enforcement officer and the Orange County Sheriff and it was being investigated if other staff could be certified to enforce the regulations.
Mike Curtis, resident, expressed concern about smoking regulations and enforcement.
After further discussion, staff was directed to bring back proposed changes in the smoking regulations relating to shared carports and public sidewalks and to strengthen the litter regulations.
9.2 Public Safety Radio System Coverage Regulations
Community Development Director Barr advised that the Orange County Sheriff’s Department requested that the City adopt regulations requiring minimum public safety radio system coverage in newly constructed building within the City. The Countywide Coordinated Communication System (CCCS) is a radio system used by law enforcement, fire, lifeguard and public works department within Orange County for both emergency and non-emergency radio communication on the 800 MHz radio bad.
Moved by Mayor Pro Tem Robbins, seconded by Councilmember Ross, and carried unanimously to approve introduction and first reading of an ordinance establishing public safety radio coverage regulations, entitled:
AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ADDING CHAPTER 7.18 TO TITLE 7 OF THE LAGUNA WOODS MUNICIPAL CODE REGARDING PUBLIC SAFETY RADIO SYSTEM COVERAGE
9.3 General Plan Amendment Proposals from the Cities of Lake Forest and Irvine
City Manager Keane reported that staff had received proposed general plan amendments from cities of Lake Forest and Irvine. She advised the proposed modifications might affect available daily trips for Moulton Parkway.
Community Development Director Barr reported that due to the City of Lake Forests’ project’s distance from the City, staff believed the proposed general plan amendments would have no significant impact to the City in aesthetics, agricultural resources, air quality and noise. However, staff would be commenting on water quality, as the City is downstream from the project area. Staff will also comment on the traffic model to ensure that it reflected the City of Laguna Woods most recent numbers.
Community Development Director Barr reported that due to the proximity of the City of Irvine general plan amendments, staff reviewed the following issues: noise, light, air quality (short term), stormwater and transportation. The City had concerns mainly with the traffic and circulation dealing with average daily trips – roadway capacity, intersection failure levels, traffic model assumptions, Moulton Parkway fair-share mitigation and MPAH extension. Staff is working with our traffic consultant to further analyze the potential traffic impact to the City.
Councilmembers expressed concern over the average daily trip numbers and staff advised they would be meeting with Irvine representatives to discuss the numbers used.
City Attorney McEwen advised there was nothing to report.
11.1 El Toro Reuse Planning Authority (Councilmember Hack)
Councilmember Hack reported that ETRPA is winding down. There will be consultant keeping watch in Sacrament. Councilmember Ring thanked Councilmember Hack for his time on ETRPA and advised that Councilmember Hack had been presented with a piece of the El Toro runway.
11.2 San Joaquin Corridor Authority (Councilmember Hack)
Councilmember Hack reported that he sent a letter to the Foothill Transportation Corridor Authority, on behalf of the City, supporting the Foothill Transportation expansion, and expressing concern about environmental issues.
11.3 Vector Control District (Mayor Bouer)
Mayor Bouer advised they are continuing to fight vectors and a program has been distributed to the cable companies. The next meeting was scheduled for Thursday.
11.4 Library Board (Mayor Pro Tem Robbins)
Mayor Pro Tem Robbins reminded the residents that the library hours were extended to 10:00 am to 4:30 pm. and the outside book drop off box was available when the library was closed.
11.5 Orange County Fire Authority (Councilmember Ross)
Councilmember Ross advised the meeting would be Thursday.
11.6 Laguna Canyon Foundation (Councilmember Ring)
Councilmember Ring reported they celebrated their 15th Birthday and showed several pictures of the celebration.
11.7 Coastal Greenbelt Authority (Councilmember Ring)
Councilmember Ring advised the next meeting would be Thursday.
11.8 Measure M Supercommittee
Councilmember Ross provided an update on the Measure M meeting
XII. PUBLIC COMMENTS
Mike Curtis, resident, advised he had not received a response from staff regarding a safety concern. City Manager Keane reported a letter had been mailed to him, but he could be provided with a copy after the meeting.
Mike Curtis also discussed an email he had sent to the City Manager. He was advised by the City attorney that emails to the City and its staff are public records.
XIII. CITY COUNCIL COMMENTS AND ANNOUNCEMENTS
Mayor Bouer reported that Sam Kirbens, a member of the Human Relations Committee had recently passed away.
Council and the audience sang Happy Birthday to Councilmember Ross who will be 90 on March 18th.
City Manager Keane advised the City would be celebrating its 7th Birthday with a cake at the Community Association meeting at which she and Copuncilmember Ring will be speaking on March 23rd and the City will have a cake at City Hall on Friday, March 24th from 10:00 am to 12:00 pm.
