AGENDA DESCRIPTION:
The Agenda descriptions are intended to give notice, to members of the public, of a general summary of items of business to be transacted or discussed.  The listed Recommended Action represents staff or a particular Committee’s recommendation.  The City Council may take any action, which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action.  Any person wishing to address the City Council on any matter, whether or not it appears on this agenda, is requested to complete a “Request to Speak” form available at the door.  The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council.  Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally.  Requests to speak to items on the agenda shall be heard at the appropriate point on the agenda; requests to speak about subjects not on the agenda will be heard during the Public Comment section of the meeting.

All proclamations listed under this section will be enacted by one vote, unless Members of the City Council request specific items be removed for separate action. Proclamations will then be read and presented.

5.1 Proclamation – Active Aging Week – September 25 – October 1, 2006

5.2 Proclamation – Race Equality Week – September 25 – 29, 2006 (agendized by Human Relations Committee)

5.3 Proclamation – Fire Prevention Week – October 8 – 14, 2006

5.4 Proclamation – Polish American Heritage Month – October 2006 (agendized by Human Relations Committee)

5.5 Proclamation – Breast Cancer Awareness Month – October 2006

VI. CONSENT CALENDAR

All matters listed under the Consent Calendar are considered routine and will be enacted by one vote.  There will be no separate discussion of these items unless Members of the City Council, the public, or staff request specific items be removed from the Consent Calendar for separate action.

6.1 City Council minutes from the regular meeting of August 16, 2006 and the adjourned regular meeting of August 22, 2006..

RECOMMENDED ACTION:
Approve minutes as submitted.

6.2 Approve the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived.

RECOMMENDED ACTION:
Waive reading of ordinances and resolutions.

6.3 Treasurer’s Report

RECOMMENDED ACTION:
Receive and File August 2006 monthly Treasurer’s Report.

6.4 Warrant Register

RECOMMENDED ACTION:
Approve the September 20, 2006 Warrant Register in the amount of $1,041,703.76.

6.5 Traffic Safety Modifications

RECOMMENDED ACTION:
Approve Transportation Advisory Committee recommendations to:

A. Install a crosswalk on the west leg of Santa Maria Avenue at Avenida Sosiega.

B. Install “No Right Turn on Red” signs on Calle Corta at El Toro Road (southbound traffic only), Calle Cortez at Moulton Parkway and Via Iglesia at Moulton Parkway.

VII. PUBLIC HEARINGS

Public Hearings are scheduled for a time certain of 2:00 p.m. or as soon thereafter as possible. City Council, when considering the matter scheduled for hearing, will take the following actions: A. Receive staff report; B. Open the Public Hearing; C. Receive Public Comment; D. Close Public Hearing; E. Council comment and questions and take appropriate actions. Those wishing to address the City Council during the Public Hearing must complete a Request to Speak Form and provide it to the City Clerk prior to the Public Hearing.

7.1 Conditional Use Permit application CUP-325 for the co-location of wireless facility on the existing mono-pine antenna structure, 24141 Moulton Parkway

RECOMMENDED ACTION:
A. Receive Staff Report.

B. Open Public Hearing.

C. Receive Public Comment.

D. Close Public Hearing.

E. Adopt a Resolution Entitled:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT CUP 325 FOR THE CO-LOCATION OF A WIRELESS FACILITY ON THE MONO-PINE ANTENNA STRUCTURE LOCATED ADJACENT TO THE EL TORO WATER DISTRICT TANKS, 24141 MOULTON PARKWAY, FILED BY ROYAL STREET COMMUNICATION.

7.2 Conditional Use Permit application CUP-326 to establish a new sign program for Carl’s Jr. and Green Burrito Restaurant, filed by National Sign and Marketing)

RECOMMENDED ACTION:
Continue the public hearing to October 18, 2006.

IX. CITY MANAGER’S REPORT

9.1 State and Federal Cable Television Legislation

RECOMMENDED ACTION:
A. Provide status update on proposed legislation.

B. Consider giving notice of non-renewal of the current Memorandum of        Understanding with the Golden Rain Foundation regarding use of public, educational and government (PEG) channels on the Laguna Woods Village cable system, and direct staff to negotiate an agreement that will protect future access to PEG channels should state and/or federal language be approved.

9.2 Barbed Wire Intrusions into Public Rights-of-Way

RECOMMENDED ACTION:
Discuss status of Laguna Woods Village  indemnification agreement and provide direction to staff.
