AGENDA DESCRIPTION: The Agenda descriptions are intended to give notice, to members of the public, of a general summary of items of business to be transacted or discussed. The listed Recommended Action represents staff or a particular Committee’s recommendation. The City Council may take any action, which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action. Any person wishing to address the City Council on any matter, whether or not it appears on this agenda, is requested to complete a “Request to Speak” form available at the door. The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council. Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally. Requests to speak to items on the agenda shall be heard at the appropriate point on the agenda; requests to speak about subjects not on the agenda will be heard during the Public Comment section of the meeting.

All proclamations listed under this section will be enacted by one vote, unless Members of the City Council request specific items be removed for separate action. Proclamations will then be read and presented.

  1. CONSENT CALENDAR

 

All matters listed under the Consent Calendar are considered routine and will be enacted by one vote. There will be no separate discussion of these items unless Members of the City Council, the public, or staff request specific items be removed from the Consent Calendar for separate action.

 

6.1   City Council minutes from the special and regular meetings of January 18, 2006.

 

RECOMMENDED ACTION: Approve minutes as submitted.

 

6.2   Approve the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived.

RECOMMENDED ACTION: Waive reading of ordinances and resolutions.

 

6.3   Treasurer’s Report

 

RECOMMENDED ACTION: Receive and File January 2006 monthly Treasurer’s Report and Second Quarter Fiscal Year 2005-06 Treasurer’s Report.

 

6.4   Warrant Register

 

RECOMMENDED ACTION: Approve the February 15, 2006 Warrant Register in the amount of $506,731.09.

 

6.5   Mid Year Budget Adjustments

 

RECOMMENDED ACTION: Adopt a resolution modifying the Fiscal Year 2005-06 budget, entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AMENDING RESOLUTION 05-11 AND THE FISCAL YEAR 2005-2006 BUDGET

 

6.6   Battery Disposal Regulations

 

RECOMMENDED ACTIION: Adopt an ordinance establishing household battery disposal regulations, entitled:

 

AN ORDINANCE OF THE CITY OF LAGUNA WOODS, CALIFORNIA ESTABLISHING RECYCLING REQUIREMENTS FOR RETAIL BUSINESSES THAT SELL BATTERIES WITHIN THE CITY

 

6.7 Donation of Supplies to City

 

RECOMMENDED ACTION: Accept donation from Boise Cascade/Office Max of three rolling duffle bags, valued at approximately $120.

 

6.8   Notice of Completion ? Elite Bobcat Service, Inc.

 

RECOMMENDED ACTION:

 

  1. Accept project completion of a contract with Elite Bobcat Service, Inc., for the hardscape portion of the El Toro Road Sidewalk Widening Project from Moulton Parkway to Paseo de Valencia.

 

  1. Release contract retention in the amount of $122,631.53 withheld per government code, 35 days following recordation of the Notice of Completion with the County of Orange.

 

  1. Exonerate project posted bonds 35 days following recordation of the Notice of Completion with the County of Orange.

 

6.9     Transportation Enhancement Activities Grant

 

RECOMMENDED ACTION: Adopt a resolution authorizing the application for grant funding, entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AUTHORIZING THE APPLICATION FOR FUNDS FOR THE TRANSPORTATION ENHANCEMENT ACTIVITY (TEA) PROGRAM UNDER THE 2005 SAFE, ACCOUNTABLE, FLEXIBLE, EFFICIENT, TRANSPORTATION EQUITY ACT – LEGACY FOR USERS FOR THE MOULTON PARKWAY LANDSCAPING ENHANCEMENT PROJECT.

 

6.10  Public Golf Cart Crossings

 

RECOMMENDED ACTION: Adopt a resolution designating additional golf cart crossings on El Toro Road and Moulton Parkway, entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, DESIGNATING PORTIONS OF PUBLIC HIGHWAYS AS GOLF CART CROSSINGS IN CONFORMANCE WITH THE CALIFORNIA VEHICLE CODE

 

VII. PUBLIC HEARINGS

 

Public Hearings are scheduled for a time certain of 2:00 p.m. or as soon thereafter as possible. City Council, when considering the matter scheduled for hearing, will take the following actions: A. Receive staff report; B. Open the Public Hearing; C. Receive Public Comment; D. Close Public Hearing; E. Council comment and questions and take appropriate actions. Those wishing to address the City Council during the Public Hearing must complete a Request to Speak Form and provide it to the City Clerk prior to the Public Hearing.

 

7.1 Cingular Wireless-Expansion of the El Toro Water District Cellular Site (CUP 286)

 

RECOMMENDED ACTION:

 

  1. Receive Staff Report.

  1. Adopt a Resolution Entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT CUP 286 FOR THE EXPANSION OF AN EXISTING “MINOR” WIRELESS FACILITY ON THE MONO-PINE ANTENNA STRUCTURE LOCATED ADJACENT TO THE EL TORO WATER DISTRICT TANK, 24141 MOULTON PARKWAY.

8.1   Extension of Office Space Lease for Assemblyman Devore

 

RECOMMENDED ACTION: Authorize the City Manager to extend the current agreement with the California Assembly Rules Committee providing City Hall office space for Assemblyman Chuck Devore through March 16, 2007.

This meeting will be adjourned in honor of former Councilman Victor Kay, who passed away on January 27, 2006.
