AGENDA DESCRIPTION: The Agenda descriptions are intended to give notice, to members of the public, of a general summary of items of business to be transacted or discussed. The listed Recommended Action represents staff or a particular Committee’s recommendation. The City Council may take any action, which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action. Any person wishing to address the City Council on any matter, whether or not it appears on this agenda, is requested to complete a “Request to Speak” form available at the door. The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council. Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally. Requests to speak to items on the agenda shall be heard at the appropriate point on the agenda; requests to speak about subjects not on the agenda will be heard during the Public Comment section of the meeting.

All proclamations listed under this section will be enacted by one vote, unless Members of the City Council request specific items be removed for separate action. Proclamations will then be read and presented.

 

5.1   Proclamation – Relay for Life

All matters listed under the Consent Calendar are considered routine and will be enacted by one vote. There will be no separate discussion of these items unless Members of the City Council, the public, or staff request specific items be removed from the Consent Calendar for separate action.

 

6.1 City Council Minutes from the regular meeting of May 19, 2004.

 

RECOMMENDED ACTION: Approve minutes as submitted.

 

6.2   Approve the reading by title of all ordinances and resolutions. Said ordinances and resolutions that appear on the public agenda shall be determined to have been read by title only and further reading waived.

 

RECOMMENDED ACTION: Waive reading of ordinances and resolutions.

 

6.3   Treasurer’s Report

 

RECOMMENDED ACTION: Receive and File May 2004 monthly Treasurer’s Report.

 

6.4   Warrant Register

 

RECOMMENDED ACTION: Approve the June 16, 2004 Warrant Register in the amount of $

 

6.5   Ambulance Regulations

 

RECOMMENDED ACTION: Adopt an Ordinance establishing general operating procedures and standards for ambulance transportation services in the City of Laguna Woods entitled:

 

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA ADOPTING CHAPTER 4.80 OF THE LAGUNA WOODS MUNICIPAL CODE AND ESTABLISHING GENERAL OPERATING PROCEDURES AND STANDARDS FOR AMBULANCE TRANSPORTATION SERVICES WITHIN THE CITY

 

6.6 Waste Disposal Agreement

 

RECOMMENDED ACTION:     Approve Amendment No. 1 to the City’s waste disposal agreement with the County of Orange, extending the current $22 contract rate though June 30, 2010 and authorize the City Manager to execute the amendment, subject to approval as to form by the City Attorney.

 

6.7 Business License Fees

 

RECOMMENDED ACTION:     Adopt a resolution establishing business license fees for massage therapy and fortunetelling, entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ESTABLISHING FEES FOR THE LICENSING AND REGULATION OF COMMERCIAL FORTUNETELLING AND MASSAGE BUSINESSES

 

6.8 Revenue Neutrality Payment to the County of Orange

 

RECOMMENDED ACTION:     Authorize the City manager to make the FY 2003-04 revenue neutrality payment to the County of Orange.

 

VII.  PUBLIC HEARINGS

 

Public Hearings are scheduled for a time certain of 2:00 p.m. or as soon thereafter as possible. City Council, when considering the matter scheduled for hearing, will take the following actions: A. Receive staff report; B. Open the Public Hearing; C. Receive Public Comment; D. Close Public Hearing; E. Council comment and questions and take appropriate actions. Those wishing to address the City Council during the Public Hearing must complete a Request to Speak Form and provide it to the City Clerk prior to the Public Hearing.

8.1   Advisory Committee Appointments

 

RECOMMENDED ACTION: Approve proposed nominations to City advisory committees.

 

8.2   November 2004 Election

 

RECOMMENDED ACTION:

 

  1. Adopt a resolution calling for a general municipal election in November 2004, entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 2, 2004 FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISION OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES

 

and

 

  1. Adopt a resolution allowing the County of Orange to conduct a general municipal election on behalf of the City of Laguna Woods, entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO CONSOLIDATE A GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 2, 2004, WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON THE DATE PURSUANT TO § 10403 OF THE ELECTIONS CODE

 

8.3   El Toro Road West Sidewalk (agendized by Councilmember Bouer)

 

RECOMMENDED ACTION: Consider modifying the sidewalk on the north side of El Toro Road, between Calle Sonora and the City edge, to remove some existing trees and widen the area available for pedestrian movement.

 

  1. CITY MANAGER’S REPORT

 

9.1   El Toro Road Sidewalk Widening and Landscape Improvements Project Contract Award

 

RECOMMENDED ACTION:

 

  1. Award a contract to Orion Contracting, Inc., in the amount of $1,454,545, plus authorized change orders not to exceed 10% of the base amount; and authorize the City Manager to execute a contract and approve change orders, subject to approval of the contract as to form by the City Attorney,

 

  1. Adopt a resolution ordering the summary vacation of public right-of-way located under or behind the walls on El Toro Road owned by United Laguna Hills Mutual, entitled

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, ORDERING THE SUMMARY VACATION OF PUBLIC RIGHT-OF-WAY LOCATED ALONG EL TORO ROAD FROM STATION NO. 48+07.98 TO STATION NO. 70+09.87

 

9.2   Cox Communications Cable Television Franchise Renewal

 

RECOMMENDED ACTION: Approve a resolution authorizing a ten (10) year renewal of the Cox Communications cable franchise with the City of Laguna Woods, entitled:

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA WOODS, CALIFORNIA, AUTHORIZING THE TEN (10) YEAR RENEWAL OF COX COMMUNICATIONS CABLE FRANCHISE WITH THE CITY OF LAGUNA WOODS

 

9.3   Senior Mobility Program

 

RECOMMENDED ACTION: Approve a fee schedule for the Senior Mobility taxi voucher program and authorize program continuation through June 30, 2005.

 

9.4   Senior Non-Emergency Medical Program Transportation Program

 

RECOMMENDED ACTION:

 

  1. Continue Senior Non-Emergency Transportations (SNET) program as previously approved by the Council.

 

OR

 

  1. Reduce SNET fees to be consistent with those proposed by South County Senior Services (SCSS).

 

OR

 

  1. Phase out existing SNET program by June 30, 2004 and shift clients to the SCSS program.

 

9.5   Gate 14 Secondary Access Report

 

RECOMMENDED ACTION: Review status and provide direction to staff.

XIII. CITY COUNCIL COMMENTS AND ANNOUNCEMENTS

 

XIV.  CLOSED SESSION

 

A     City Council will meet in closed session pursuant to Government Code Section 54956.8, to give direction to it’s real property negotiator, Leslie Keane, with respect to the purchase of an approximately one acre property located at 24264 El Toro Road (APN 621-121-27). Negotiating party: Raintree Realty LLC. Under negotiation: price and terms of payment.

 

  1. The City Council will meet in closed session to confer with legal counsel regarding one matter of potential litigation, pursuant to the provisions of Government Code Section 54956.9(b).

 

  1. ADJOURNMENT

 

The meeting is adjourned to an Adjourned Regular Meeting at 2:00 p.m. on June 30, 2004 at the Laguna Woods City Hall, 24264 El Toro Road, Laguna Woods, CA 92653.
